General Terms and Conditions of Sale
GENERAL TERMS AND CONDITIONS OF SALE (T&Cs)
These General Terms and Conditions of Sale govern sales made on the Carthageparis website, owned by Aminam, a simplified joint-stock company (société par actions simplifiée) with a share capital of €20,000, registered with the Paris Trade and Companies Register under number 938 593 183 R.C.S. Paris, with its registered office at 60 rue François 1er, 75008 Paris.
1. PURPOSE
These terms and conditions are intended to define the terms of sale between Carthageparis and any adult natural person wishing to make a purchase via the website www.carthageparis.com, hereinafter referred to as "the Customer".
2. PRODUCTS
The products offered are exclusively brand-new clothing and accessories. The photographs presented on the website are as accurate as possible but cannot guarantee a perfect likeness with the product. Carthageparis cannot be held liable for any minor differences.
3. PRICES
Prices are indicated in euros, inclusive of all taxes (VAT included), excluding delivery costs. Carthageparis reserves the right to modify its prices at any time, but undertakes to apply the price in force at the time of the order.
4. ORDERS
Orders are placed exclusively online via the website. Any order constitutes acceptance of the prices and descriptions of the products available for sale. The order is validated upon receipt of payment and confirmed by email.
5. PAYMENT
Payment is due immediately upon ordering. It is made by credit card, PayPal or any other secure method offered on the website. Payments are processed through a secure payment platform.
6. DELIVERY
Deliveries are made to mainland France (and internationally depending on available options). Delivery times are given as an indication only. In the event of a delay, Carthageparis cannot be held liable, but undertakes to inform the Customer and provide tracking information.
Delivery is free in France and the EU for any order exceeding €200. If, on an order exceeding €200, one or more products are returned and the total amount of products kept falls below €200, the delivery costs corresponding to the method chosen by the customer will be deducted from the refund for the returned products.
7. RIGHT OF WITHDRAWAL
In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to provide any justification or pay any penalty.
Products must be returned in perfect condition, unworn, unwashed, in their original packaging. In accordance with Article L.221-23 of the French Consumer Code, return shipping costs remain the responsibility of the customer when exercising the right of withdrawal.
Returns are free of charge in France — a prepaid shipping label will be provided at no cost. For returns from countries outside France, a label will be provided and the return shipping costs will be deducted from the refund.
8. WARRANTIES
All products benefit from the statutory warranty of conformity (Articles L217-4 to L217-14 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code). In the event of non-conformity, the Customer may request repair, replacement or refund of the product.
9. LIABILITY
Carthageparis cannot be held liable for indirect damages related to the use of products. Its liability is in any event limited to the amount of the order.
10. PERSONAL DATA
The personal data collected is necessary for processing orders and managing the commercial relationship. In accordance with the GDPR, the Customer has the right to access, rectify, object to and delete their data. They may exercise these rights by writing to: contact@carthageparis.com.
11. INTELLECTUAL PROPERTY
All elements of the website www.carthageparis.com (texts, images, logo, design) are and remain the exclusive intellectual property of Aminam. Any reproduction, in whole or in part, is strictly prohibited without prior written authorisation.
12. APPLICABLE LAW
These T&Cs are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts will have sole jurisdiction.
